Platform Nature: Build-a-Dress acts as an intermediary platform connecting customers with independent manufacturers. We do not directly manufacture, produce, or ship products. All manufacturing is performed by independent third-party seamstresses who are not our employees or agents.
Due to the custom-made nature of our products, all sales are final. No refunds, cancellations, or modifications are available once payment is submitted. Please ensure you are completely satisfied with your design and measurements before submitting payment.

All payments are processed securely through Stripe, our third-party payment processor. Payment is required at the time of order placement. Prices are subject to change without notice. All sales are final - no refunds are provided for any reason once payment is submitted.
Payment Processing: By making a payment, you authorize us to charge your payment method for the full amount of your order. You agree to provide accurate payment information and authorize us to process payments through our designated payment processors.
Currency and Taxes: All prices are displayed in the currency specified on our platform. You are responsible for any applicable taxes, duties, or fees associated with your purchase.
Production typically takes 5-7 weeks from order confirmation. Delivery times may vary based on complexity, current demand, and manufacturer availability. We will provide tracking information once your dress ships.
Cancellation Policy: All sales are final. Due to the custom-made nature of our products, we do not offer refunds or cancellations for any reason once payment is submitted. Custom-made items cannot be cancelled, modified, or refunded after the payment action is completed.
Modifications: Due to the custom-made nature of our products, design modifications cannot be made after payment is submitted. All design decisions must be finalized before the payment action is completed.
Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, labor disputes, or supply chain disruptions.
Our platform utilizes artificial intelligence and machine learning technologies to generate dress designs. By using our service, you acknowledge and agree to the following:
Platform IP: The Build-a-Dress platform, including its technology, algorithms, software, and proprietary systems, are owned by Build-a-Dress and protected by intellectual property laws.
AI-Generated Designs: All designs created through our AI system are owned by Build-a-Dress. You receive a limited, non-exclusive, non-transferable license to use the final product for personal use only. You may not reproduce, distribute, or commercialize AI-generated designs.
User Content: You retain ownership of any original content you provide (such as design descriptions or preferences), but grant us a license to use such content for service provision and AI training purposes.
Third-Party Rights: You represent that your use of our service and any content you provide does not infringe upon the intellectual property rights of third parties.
We are committed to protecting your privacy. Your personal information, including measurements and design preferences, is collected and stored securely. We do not share your data with third parties except as necessary for service delivery.
Data Processing: By using our service, you consent to the collection, processing, and storage of your personal data as described in our Privacy Policy, which is incorporated by reference into this agreement.
International Transfers: Your data may be transferred to and processed in countries other than your own. We implement appropriate safeguards to protect your data in accordance with applicable laws.
Data Rights: You have the right to access, correct, or delete your personal data, subject to legal requirements and our legitimate business interests.
Independent Manufacturers: All seamstresses and manufacturers on our platform are independent contractors, not our employees or agents. We do not control their work quality, methods, or business practices.
Third-Party Services: Our service relies on third-party providers including Stripe (payments), Wise (international transfers), and various hosting and analytics services. We are not responsible for the performance, security, or availability of these third-party services.
Manufacturer Disputes: While we facilitate communication and provide dispute resolution services, we are not liable for disputes between customers and manufacturers that cannot be resolved through our platform.
Platform Liability: Build-a-Dress is not liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service. Our total liability is limited to the amount paid for the specific service.
Manufacturer Liability: We are not liable for the actions, omissions, or quality of work performed by independent manufacturers. Any claims related to manufacturing defects or quality issues should be directed to the manufacturer through our platform.
Service Availability: We do not guarantee uninterrupted or error-free service. The platform may be temporarily unavailable due to maintenance, technical issues, or other factors beyond our control.
Fit and Measurements: We are not responsible for fit issues resulting from inaccurate measurements provided by customers or changes in body measurements after order placement.
No Warranties: THE PLATFORM, ALL AI-GENERATED DESIGNS, AND ANY PRODUCTS OR SERVICES OBTAINED THROUGH THE PLATFORM ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Indemnification: You agree to indemnify, defend, and hold harmless Build-a-Dress, its officers, directors, employees, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (i) your breach of this agreement, (ii) your misuse of the service, or (iii) your violation of any law or third-party right.
Governing Law: This agreement is governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles.
Jurisdiction and Venue: You agree that any legal action or proceeding arising under this agreement will be brought exclusively in the state or federal courts located in Delaware, and you hereby consent to the personal jurisdiction and venue therein.
Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.
Small Claims Exception: Either party may bring claims in small claims court if the claim qualifies for such court's jurisdiction.
Termination by User: You may terminate your account at any time by contacting us or deleting your account through the platform.
Termination by Company: We may suspend or terminate your account immediately if you violate these terms, engage in fraudulent activity, or for any other reason at our sole discretion.
Effect of Termination: Upon termination, your right to use the service ceases immediately. We may retain certain information as required by law or for legitimate business purposes.
Survival: Sections 6 through 11, 14, and any other provisions which by their nature should survive termination will survive termination of this agreement.
Modification: We reserve the right to modify this agreement at any time. Material changes will be effective 30 days after posting, with notice provided through the platform or email. Non-material changes are effective immediately upon posting.
Acceptance of Changes: Continued use of the service after changes become effective constitutes acceptance of the modified terms.
Notices: We may provide notices through the platform, email, or other reasonable means. You are responsible for keeping your contact information current.
Severability: If any provision of this agreement is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement: This agreement, together with our Privacy Policy and Refund Policy, constitutes the entire agreement between you and Build-a-Dress regarding the service.
Waiver: Our failure to enforce any provision of this agreement does not constitute a waiver of that provision or any other provision.

If you believe that any content available through the service infringes your copyright or other intellectual-property rights, please send a written notice to support@build-a-dress.com that includes the information required by 17 U.S.C. §512(c)(3). Upon receipt of a valid notice, we will remove or disable access to the allegedly infringing material and, where appropriate, terminate repeat infringers.
